The Food and Drug Administration (“FDA”), an entity responsible for protecting public health, is understaffed and underfunded for this task. Up until approximately 2002, an FDA approval of a drug or device was largely regarded as an additional layer of protection to state tort laws. More recently however, with changes in the President’s office and FDA leadership, our U.S. Supreme Court has effectively eliminated many state protections. The rational is based upon “preemption” arguments which generally hold that FDA approvals (based primarily on the information provided by drug and device manufacturers themselves) cannot - and should not - be questioned later by state tort claims. Therefore, an injured party must do more than prove the myriad of defenses that involve the Food and Drug Administration which defendants often use as a shield from liability.
