REFERRAL FEE POLICY

Mower, Carreon & Desai, LLP welcomes referrals from other lawyers as well as from current and former clients.  We are a civil litigation firm with extensive experience and expertise in class action, employment, personal injury, business and insurance disputes. 

Our firm welcomes the referral of matters:

1. •outside your area of expertise
   

2. •where there is a conflict of interests with clients
   

3. •in the Orange County area that are either inconvenient for your firm to handle or where no one in your firm is admitted to practice in California
   

However, our practice is limited.  We do not handle transactional matters such as drafting business agreements or corporate documents, real estate transactions, estate or tax planning, divorce, or criminal cases.  Since we often get requests from clients to provide services in those important areas of the law, and since we try to help our clients with the task of securing experienced legal representation even in those areas in which we do not actively practice, we are often “referring” attorneys ourselves.  Over the years we have developed some very rewarding “cross referral” relationships with practitioners in other legal specialties.

In compliance with the Rules of Professional Conduct relative to referrals among lawyers we do pay referral fees to attorneys who send us cases that we accept for further prosecution.  Those fees are on a case by case basis and may vary depending on several factors including:

1. •the type of case and the applicable fee structure
   

2. •the complexity and expected duration of the case
   

3. •the projected total value of the case
   

4. •whether or not the referring attorney contemplates a continued involvement and contribution of effort in the prosecution of the case or is instead making a total referral with minimal further involvement.
   

Referral fees are calculated as a percentage of the overall fee and may range from 10% to 50% depending upon the application of the previously referenced factors.

Of course, all referral arrangements are disclosed to the client, who must approve of the referral, and are structured so as not to increase the costs of the legal representation to the client.
