Mower,
Carreon & Desai, LLP along with two other well-regarded
law firms in Florida, have filed a complaint for violations
of the Consumer Legal Remedies Act against Hyundai Motor
America. The nationwide class includes all persons who purchased
or leased automobiles for which Hyundai understated in marketing
materials the horsepower of such vehicles. The complaint
alleges that during the last ten years or so, Hyundai has
overstated the horsepower rating for many of its automobiles
sold and leased in North America in its written marketing
materials, including dealer catalogues, print advertisements
and media kits. On behalf of the class, Mower, Carreon &
Desai, LLP is seeking an order from the court imposing a
constructive trust upon Defendant's ill-gotten gains, freezing
Defendant's assets traceable to such conduct, and awarding
the Plaintiffs and the class members damages as a result
of the deceptive advertisements and sales practices. We
recently helped to obtain an approximatly $125 Million claims-made
settlement against Hyundai for the allegations contained
within the Complaint; however, Kia Motors has not agreed
to the terms of this settlement. As such, litigation continues
against this defendant.
