Mower, Carreon & Desai, LLP along with other counsel, alleged that Defendants have illegally sent unsolicited facsimile advertising in violation of the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227 to a large class of individuals. The Plaintiffs contend that the TCPA provides for mandatory liquidated statutory damages of $500.00 per violation. The class is also seeking an order enjoining the Defendants from sending any further facsimile solicitations without prior written consent. This case was recently settled with final Court approval. The result was favorable for the class members.
