This is a consumer class action on behalf of all persons who bought or leased in the State of California a new model year 2004 through 2007 Nissan or Infiniti automobile. Plaintiffs allege that Defendants caused odometers on Nissan and Infiniti automobiles to overstate the actual miles driven by at least 2%, resulting in, among other things, prematurely expiring vehicle warranties and excess mileage charges on leased vehicles. This action seeks injunctive relief, disgorgement, restitution, imposition of a constructive trust and monetary damages.
