Former loan agents and processors have brought a class action case against Instafi.com (formerly known as Axiom Mortgage) based upon the company's failure to pay overtime and provide meal breaks as required under California law. Investigation has revealed that loan agents and processors regularly worked in excess of 40 hours per week but were improperly classified as "exempt" and unlawfully denied overtime compensation. Although we obtained a good settlement on behalf of the class members, Instafi filed for state receivership just before any money could be distributed to the class members. The litigation, however, continues against Sean Roberts - under joint employer theories - for his role at Instafi.
