Mower,
Carreon & Desai, LLP on behalf of California consumers
filed a class and representative action against McDonald's
and its promotional agent, Simon Marketing, as a result
of fraudulent activities related to its "Who Wants
To Be A Millionaire?" and "Monopoly" promotional
games. During 2001, the FBI alleged that there had been
a security failure regarding the seeding of high-value prizes
during certain of the games. The scheme was publicly disclosed
in August 2001. As a result of the removal of the winning
game pieces from random public distribution, the odds of
the putative class members winning a high-value prize were
reduced or made nonexistent. Mower, Carreon & Desai,
LLP helped to negotiate a nationwide settlement of these
claims. The case recently received final approval from the
Circuit Court of Cook County, Illinois.
